Hyrazone Company (hereinafter referred to as “Hyrazone” or “we”) provides decentralized online services, including but not limited to GPU rental, decentralized data storage, and blockchain-related services through the official website https://hyrazone.com. This Legal Disclaimer (hereinafter referred to as the “Disclaimer”) applies to all users, organizations, or entities (hereinafter referred to as “Customers”) who use our services. By using the services, Customers agree to the terms of this Disclaimer.

1. Scope of Application

This Disclaimer applies to all transactions, usage activities, and interactions related to Hyrazone’s decentralized online services, including but not limited to GPU rental, blockchain integration, or use of computing resources provided via https://hyrazone.com. This Disclaimer supplements Hyrazone’s Terms of Use (https://hyrazone.com) and Privacy Policy (https://hyrazone.com/en/content/privacy-policy).

2. Legal Liability Disclaimer

2.1. Customer Data Responsibility

Data storage and usage: Hyrazone shall bear no legal responsibility for any data stored, processed, or used by Customers on our GPUs or decentralized platforms. Customers are solely responsible, under Vietnamese and international law, for the content of their data, including but not limited to acts of copyright infringement, intellectual property violations, state secret breaches, cybersecurity violations, or using data for illegal purposes such as gambling, fraud, cyberattacks (DDoS), unauthorized cryptocurrency mining, or spamming.
Loss or unauthorized access: Hyrazone is not liable for any data loss, damage, or unauthorized access resulting from Customer’s fault (e.g., failing to secure access keys, passwords, or private keys), intentional acts of third parties, or incidents beyond Hyrazone’s control.

2.2. Indirect or Consequential Damages
Hyrazone shall not be liable for any indirect, incidental, or consequential damages arising from service use, including but not limited to loss of profit, data, business reputation, or business opportunities, even if Hyrazone has been advised of the possibility of such damages.

2.3. Service Information Errors
While Hyrazone endeavors to ensure the accuracy of service information (pricing, features, technical specifications) published on https://hyrazone.com, we assume no liability for unintended errors or omissions, including price display errors, technical description mistakes, or inaccurate service information. Customers are responsible for verifying information before registering or making payment.

2.4. Technical and Third-Party Incidents
Hyrazone shall not be responsible for incidents beyond our control, including but not limited to:

Blockchain network congestion or failures from decentralized protocols.
Incidents from third-party service providers (e.g., payment gateways, network infrastructure providers).
Malicious acts such as cyberattacks or security breaches not originating from Hyrazone’s systems.
In such cases, Hyrazone will cooperate with Customers to minimize damage to the extent possible but assumes no compensation obligation.

2.5. Misuse or Improper Use of Decentralized Technology
Hyrazone bears no responsibility for risks arising from Customers’ misuse or improper use of decentralized services, including but not limited to:

Loss of private keys, access codes, or login credentials due to Customer error.
API integration failures or misconfigurations during service usage.
Use of services for unlawful activities.

2.6. Promotional Programs
Promotions, discounts, or offers published on the website may change or terminate without prior notice. Hyrazone is not liable if Customers fail to participate or do not meet the eligibility criteria.

3. Legal Compliance

Customers are solely responsible for ensuring their use of Hyrazone’s services complies with applicable Vietnamese laws, including the Civil Code, Commercial Law, Law on Consumer Protection, Cybersecurity Law, and Decree 13/2023/ND-CP on personal data protection, as well as applicable international regulations (e.g., GDPR). Hyrazone is exempt from legal liability for any violations arising from Customer conduct.

4. Limitation of Liability

In all cases, Hyrazone’s compensation liability (if any) shall not exceed 8% of the contract value or the value of services paid for, unless otherwise agreed in writing. Hyrazone shall not be liable for indirect, incidental, or consequential damages, even if advised in advance.

5. Force Majeure

Hyrazone is exempt from liability for incidents arising from force majeure events, including but not limited to natural disasters, war, epidemics, strikes, or technical failures from third-party providers. In the event of force majeure, Hyrazone will notify Customers within 24 hours and cooperate to minimize damages but bears no compensation obligation.

6. Dispute Resolution

Any disputes arising from service use shall be prioritized for settlement through negotiation within 30 days. If no agreement is reached, disputes shall be submitted to the competent People’s Court of Vietnam, applying Vietnamese law. Customers agree that Hyrazone is exempt from legal liability for disputes arising from Customer violations.

7. Updates and Modifications

Hyrazone reserves the right to update or modify this Disclaimer without prior notice. Changes will be publicly announced at https://hyrazone.com and will take immediate effect for new transactions. Customers are responsible for periodically checking for updates.
